Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Optoref website and its content (the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Purpose and intended users
The Service is an informational memory aid for qualified, licensed eye care professionals. It is not intended for use by patients or members of the public, and it is not intended to be used to make clinical decisions without independent verification. Nothing in the Service is directed at any individual patient.
2. Not medical advice; no professional relationship
The Service does not provide medical, optometric, pharmaceutical or other professional advice, diagnosis or treatment. It is not a substitute for your own clinical judgement, examination and history-taking, the current manufacturer fitting guide, the approved prescribing information, or applicable clinical guidelines. Your use of the Service does not create any clinician-patient, professional, fiduciary or advisory relationship between you and Optoref or its contributors. You remain solely responsible for all clinical decisions you make.
3. Accuracy, completeness and changes
Content is compiled from publicly available sources, including manufacturer fitting guides, package inserts, government drug labelling and published literature. It may be incomplete, contain errors, or be out of date, and it is not exhaustive. Lens parameters, drug information, calculator outputs and management summaries are provided for convenience only. You must verify every specification, dose, interaction, contraindication and calculation against the primary source before you fit, prescribe, dispense or advise. The Service and its content may be changed, suspended or discontinued at any time without notice.
4. No warranties
The Service is provided “as is” and “as available”, without warranties or conditions of any kind, whether express, implied or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Optoref does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.
5. Limitation of liability
To the fullest extent permitted by applicable law, Optoref and its owners, contributors, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or for any personal injury, clinical harm, or professional or regulatory consequence, arising out of or relating to your access to, use of, or inability to use, or reliance on, the Service or its content, whether based in contract, tort (including negligence), strict liability or any other theory, and whether or not Optoref has been advised of the possibility of such damages. To the fullest extent permitted by law, the total aggregate liability of Optoref for all claims relating to the Service shall not exceed one hundred US dollars (US $100). Some jurisdictions do not allow certain of these exclusions or limitations; in those jurisdictions liability is limited to the greatest extent permitted by law.
6. Assumption of risk and indemnity
You use the Service at your own risk and accept full responsibility for any use you make of its content. You agree to indemnify and hold harmless Optoref and its owners and contributors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Service or your breach of these Terms.
7. Acceptable use
You agree not to: enter identifiable patient information into the Service; use the Service in a way that breaches any law or professional obligation; scrape, bulk-download, republish or resell the content; or attempt to disrupt or gain unauthorised access to the Service.
8. Intellectual property
The design, original text, code and arrangement of the Service are owned by Optoref. Factual data about third-party products is not claimed as proprietary. Product names, brand names and logos referenced in the Service are the trademarks of their respective owners and are used for identification and reference only; their use does not imply any affiliation or endorsement.
9. Third-party links
The Service links to third-party websites (such as manufacturer portals). Optoref does not control and is not responsible for the content, accuracy or practices of those sites.
10. Changes to these Terms
These Terms may be updated from time to time. The “last updated” date above will change and continued use of the Service after an update constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of [your state/country, to be completed], without regard to its conflict-of-laws rules, and you submit to the exclusive jurisdiction of the courts located there.
